While we create high-quality, psychology-driven copy designed to improve conversions, your actual results depend on many factors beyond copywriting, including:

  • Your product or service quality
  • Market conditions and competition
  • Your pricing strategy
  • Traffic quality and volume
  • Implementation and testing
  • Customer service and fulfillment
  • Overall business operations
  • Economic conditions
  • Industry changes and regulations

Any case studies, testimonials, or examples of past results are not guarantees of future performance. Your results may vary significantly.

Example: If we write a landing page that converted at 5% for one client, that doesn't mean your landing page will achieve the same results. Your market, offer, traffic, and countless other factors affect conversion rates.

Client Responsibilities

As our client, you are fully responsible for:

Legal & Regulatory Compliance

  • Ensuring all copy complies with federal, state, and local laws
  • Meeting industry-specific regulations (FDA, FTC, SEC, HIPAA, etc.)
  • Obtaining necessary legal review before publication
  • Verifying all claims and statements are truthful and substantiated
  • Securing appropriate licenses and permits for your business
  • Protecting intellectual property rights

Implementation & Testing

  • Properly implementing copy on your platforms
  • A/B testing and optimization for your audience
  • Maintaining website functionality and user experience
  • Tracking and measuring results
  • Making necessary adjustments based on performance

Business Operations

  • Delivering products/services as promised in the copy
  • Handling customer service and support
  • Managing refunds, returns, and complaints
  • Maintaining appropriate business insurance
  • Fulfilling orders and meeting delivery promises
  • Protecting customer data and privacy

Data Breach Notification

While we implement industry-standard security measures to protect your information, we want you to know our policy if a data breach occurs:

If a Breach Occurs:

  • We will notify affected clients promptly via email within 72 hours of discovering the breach
  • We will inform you what information was compromised and what we're doing about it
  • We will provide guidance on steps you can take to protect yourself
  • We will notify appropriate authorities as required by law
  • We will provide a dedicated contact for questions and assistance

Our Commitment: Transparency and prompt communication are priorities. You'll receive clear information about what happened, what data was affected, and what actions we're taking to prevent future incidents.

Limitation of Liability

Our maximum liability is strictly limited to the amount you paid for the specific project.

Under no circumstances will WordsmithDirect or Brian Pollard be liable for:

  • ❌ Lost profits or revenue
  • ❌ Loss of business opportunities
  • ❌ Indirect or consequential damages
  • ❌ Damage to reputation or goodwill
  • ❌ Costs of replacement services
  • ❌ Loss of data or information
  • ❌ Legal fees or penalties
  • ❌ Any damages exceeding the project fee

This limitation applies even if we've been advised of the possibility of such damages and regardless of the legal theory under which damages are sought.

Example: If you pay $5,000 for a sales page and later claim $50,000 in lost sales, our maximum liability remains $5,000 (the amount you paid).

Confidentiality

Your business information is strictly confidential and will never be shared with competitors.

We Promise To:

  • Keep all project details strictly confidential
  • Never share your information with competitors
  • Not disclose proprietary strategies or trade secrets
  • Only use your name/testimonial with explicit written permission
  • Protect sensitive business data with appropriate security measures
  • Maintain confidentiality even after our project ends

Exceptions:

We may disclose information only if:

  • Required by law or court order
  • You give explicit written consent
  • Necessary to protect our legal rights

Testimonials and Case Studies

Any testimonials, case studies, or success stories on our website represent individual client experiences. Your results will vary based on your unique situation, market, and implementation.

We may request your testimonial after successful projects. You're never obligated to provide one, and we'll always ask written permission before using your name, company, or results in our marketing.

FTC Compliance: All testimonials represent actual client experiences, but individual results vary. We cannot guarantee you'll achieve similar results.

Indemnification

You agree to defend, indemnify, and hold harmless WordsmithDirect and Brian Pollard from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the copywriting we provide
  • Your products or services
  • Your business operations
  • Violation of laws or regulations
  • Infringement of third-party rights
  • Breach of these terms
  • False or misleading claims in your marketing

This means if someone sues us because of how you used our copy or ran your business, you'll cover our legal costs and any damages.

Dispute Resolution

We prefer to resolve any issues directly through communication. If we have a dispute:

  1. First: Contact us directly to discuss the issue
  2. Second: If needed, we'll try mediation
  3. Last Resort: Legal action in Hamilton County, Ohio courts

All disputes are governed by Ohio law, regardless of where you're located.
